Introduction & Acceptance


Welcome to StreamMySport! StreamMySport is a mobile application and service provided by Tutun Solutions LLC (“Company”, “we”, “us” or “our”). These Terms of Use (“Terms”) govern your access to and use of the StreamMySport application, related website, and all services, features or content provided through them (collectively, the “Service”). By downloading or using StreamMySport, creating an account, or by streaming any content via our Service, you (“User” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you must not use the Service.

Eligibility: You must be at least 13 years old to use StreamMySport. If you are between 13 and the age of legal majority in your country (typically 18), you may only use our Service under the supervision of a parent or legal guardian who agrees to these Terms. By allowing a minor to use the Service, the parent/guardian assumes full responsibility for the minor’s use. The Service is not intended for children under 13, and such use is prohibited. By accepting these Terms, you represent that you meet the age requirements and have the legal capacity to enter a binding contract. If you are using the Service on behalf of an organization (such as a sports club or school team), you further represent that you have the authority to agree to these Terms on that organization’s behalf, and “you” as used in these Terms will include both you and that organization.

Updates to Terms: We reserve the right to modify or update these Terms from time to time. We will notify users of any material changes by posting the updated Terms within the app or via other communication. The “Last updated” date at the end of this document indicates when changes were last made. Your continued use of the Service after updated Terms are posted (and effective) constitutes your acceptance of the changes. If you do not agree to a revised term, you should stop using the Service and (if applicable) cancel any subscriptions. For users in the European Union or certain jurisdictions, we will provide advance notice of changes when required by law.

Accounts & Registration


To access certain features (such as live streaming), you need to create a StreamMySport user account. You can register by providing a valid email address and setting a password, or by using an approved third-party login (such as Sign in with Google, Facebook Login, or Apple Sign-in).

  • Account Information: You agree to provide true, accurate, current, and complete information during registration and to keep it up-to-date. You must not impersonate someone else or create an account for anyone other than yourself (except authorized accounts for a minor of whom you are a parent/guardian or for an organization you represent).
  • Third-Party Logins: If you choose to register or log in via a third-party service (Google, Facebook, Apple), you authorize us to obtain from that service certain personal information (such as your name and email) as permitted by that service’s privacy policies, to create your StreamMySport account. Note that logging in via a third-party is also subject to that third party’s terms and privacy policy. For example, if you use Facebook Login, you must comply with Facebook’s terms of service; if your Facebook account is disabled or compromised, it may affect your access to our Service. We are not responsible for any issues arising from third-party accounts. You can revoke our access to your data on those services (for example, you may revoke StreamMySport’s access to your Google account via your Google security settings).
  • Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password with anyone or allow others to use your account. If you suspect unauthorized use of your account, you must notify us immediately at info@streammysport.com. We are not liable for any loss or damage arising from the unauthorized use of your account (you may be held liable for losses incurred by us or others due to such unauthorized use).
  • Account Use: You agree not to sell, rent, license, or transfer your StreamMySport account to any other person. You must use your account only for yourself or your own organization. You may not create multiple accounts to evade restrictions or for any abusive purpose. We reserve the right to refuse registration, or to suspend or terminate accounts that violate these requirements.

Profile and Username: If the Service allows you to set a username or profile, you must not select a name that is obscene, offensive, or infringes someone’s rights. We may reclaim or require you to change inappropriate usernames.

License Grant & Permitted Use


Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the StreamMySport mobile application and related software on a compatible device that you own or control, and to access our Service, solely for lawful, personal and non-commercial use (specifically, for streaming amateur sports events that you have rights or permission to stream and for viewing such streams). This license is provided for the sole purpose of enabling you to use and enjoy the benefit of the Service as intended by us, in accordance with these Terms.

All rights not expressly granted to you are reserved by us and our licensors. This license does not allow you to do any of the following:

  • You may not copy, reproduce, distribute, publicly display, or publicly perform the Service or any part of it, except as explicitly enabled by a feature of our Service (for example, streaming your video via our app to authorized platforms).
  • You may not modify, adapt, translate, or create derivative works of the Service or any component of it.
  • You may not reverse engineer, decompile, or attempt to extract the source code of the application or any part of our Service, except to the limited extent allowed by applicable law notwithstanding this prohibition.
  • You may not rent, lease, lend, sell, sublicense, or otherwise transfer the app or any of your rights hereunder to any person or entity.
  • You may not remove, obscure, or alter any copyright, trademark, or other proprietary notices on or in the Service or any content provided by us. For example, you may not remove any StreamMySport logos or watermarks from the video stream in the free version.
  • You may not use the Service for any purpose that is commercial or profit-making for yourself, except as expressly permitted. The Service is intended for amateur and personal use. (By way of example, you are allowed to stream your local team’s matches and even include sponsor logos on the stream if using our features, but you may not resell our streaming service or charge viewers through our platform without our written approval.)

Intellectual Property Ownership: The Service (including the app, website, and all content provided by us such as software, design elements, text, graphics, logos, videos produced by us, and the “StreamMySport” name and trademarks) is protected by copyright, trademark, and other intellectual property laws. Tutun Solutions LLC retains all right, title, and interest in and to the Service and all associated intellectual property. These Terms do not grant you any ownership of any intellectual property rights in our Service or content – only the limited usage rights as expressly provided above. You agree not to use our name, logos, or other trademarks without our prior written consent, except as necessary for legitimate references to our Service (e.g., you may say “I stream via StreamMySport” factually).

User Content and Streams


4.1 Your Content Ownership: StreamMySport allows you to create, transmit, and share content, including live video and audio streams of sports events, real-time score data, commentary, images (like team logos or graphics overlays), and other materials (“User Content”). You retain any and all rights you hold in your User Content. We do not claim ownership of the content you stream through our Service. However, by using the Service and transmitting User Content, you are granting us certain rights as described below.

4.2 License to StreamMySport: By streaming or otherwise providing User Content via the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, transmit, distribute, adapt (e.g., adjust video quality or format), display, and perform that User Content solely for the following purposes: (a) to operate and maintain the Service (for example, to relay your live stream to the platforms or viewers you select, to record or buffer streams if necessary for technical delivery, and to display score data or thumbnails), and (b) to promote or market the Service. This promotional use may include, for instance, featuring a short clip or screenshot of your stream on our website, social media, or marketing materials to illustrate how the Service works. We will not, however, sell your content to third parties or use it outside the context of promoting or providing our Service without obtaining additional permission from you.

This license is granted to us for as long as your User Content is available on or through our Service, and for a commercially reasonable time thereafter. If you delete User Content or if your account is terminated, we will cease any further active use of that content for promotion. Please note that removed content may persist in backup copies for a limited period (but will not be available to others), and that if your content has been shared or re-streamed to third-party platforms (e.g., recorded on YouTube or clips made on Twitch), we cannot retroactively delete or control those copies. Also, if we have already used your content in our promotional materials, we may continue to use those materials (for example, if a brochure or video has been created featuring a clip of your stream, we are not required to revise it).

4.3 License to Other Users: You also grant each user who can view your content via the Service (for example, viewers of a live stream) a non-exclusive license to access and view that content through the Service as permitted by these Terms and the functionality of the Service. You understand that when you stream to a third-party platform (like YouTube/Facebook/Twitch), the terms of that platform will govern what viewers can do with your content on that platform.

4.4 Your Responsibilities for Content: You represent and warrant that you have all necessary rights to broadcast and share each element of content that you stream using our Service. This includes obtaining consent from all individuals who are identifiable in your stream (such as players, coaches, or spectators, especially if they are minors, you should have permission from their parent/guardian or the hosting organization) and securing rights to any third-party material included (e.g., music playing in the venue or logos). You agree that your User Content will not: (i) infringe or violate any third party’s intellectual property rights, privacy or publicity rights, or other legal rights; (ii) contain any material that is defamatory, obscene, harassing, harmful to minors, pornographic, or otherwise violates any law or regulation; or (iii) violate any community standards of the platform to which it is streamed (for example, if streaming to YouTube, your content must comply with YouTube’s Community Guidelines).

You are solely responsible for the content you stream and the consequences of sharing it. We do not pre-screen User Content, and we do not endorse or guarantee any User Content. We assume no liability for any User Content transmitted through our Service – the user who provides the content is exclusively responsible for it. However, we reserve the right (but have no obligation) to remove, block, or disable access to any User Content at our discretion, at any time and without notice, if we believe it violates these Terms, the law, or the rights of any third party. We may also terminate or suspend the account of any user who repeatedly infringes copyrights or other intellectual property rights (in accordance with our DMCA policy in Section 8) or who violates these Terms in other ways.

4.5 No Storage or Backup: The Service is not designed as a long-term video hosting or backup solution. While we may temporarily buffer or record streams to facilitate relays (depending on technical requirements), we do not guarantee any archival of your streams. We do not provide permanent cloud storage of your videos by default. (For saving broadcasts, you should use the recording feature to save to your device or rely on the third-party platform’s recording feature, such as YouTube’s archive of live streams.) Accordingly, we are not responsible for any loss of User Content; please ensure you record or save locally any streams that you wish to keep.

Prohibited Uses


You agree to use StreamMySport only for lawful purposes and in accordance with these Terms. You must NOT:

  • 5.1 Illegal Activities: Use the Service to violate any law or regulation, or for any unlawful, fraudulent, or malicious purpose. This includes, but is not limited to, streaming content or engaging in behavior that constitutes hate speech, harassment, stalking, threats, or any form of illegal activity. Do not use our Service to transmit content that is defamatory, libelous, pornographic (no nudity or sexually explicit content), or otherwise objectionable or unlawful (e.g., depicting extreme violence or cruelty).
  • 5.2 Intellectual Property Infringement: Use the Service to stream or share content that you do not have the rights to. For example, do not stream professional sports games, TV broadcasts, movies, music concerts, or any copyrighted material unless you have permission from the rights holder. Do not include third-party music, logos, or trademarks in your stream without authorization. You must also respect others’ privacy and publicity rights – e.g., do not stream someone’s likeness or personal data without consent where required. Repeated copyright infringement may result in termination of your account.
  • 5.3 Cheating or Unauthorized Game Footage: (If applicable) If streaming e-sports or sports video games, follow the game publisher’s content guidelines. Do not stream hacks, cheats, or engage in behavior that violates the terms of the games you broadcast.
  • 5.4 Interference and Hacking: Do not interfere with the operation of the Service or any servers or networks used to provide it. This means you must not deploy any viruses, worms, malware, or any other code intended to disrupt or harm the software or viewers. You may not attempt to gain unauthorized access to any systems or accounts related to the Service (no hacking). Also, do not flood or overload the service (e.g., no deliberate DDOS attacks or spamming requests).
  • 5.5 Reverse Engineering and Misuse: You must not reverse engineer, decompile, or disassemble the app or any aspect of the Service, except as allowed by law. You must not misuse the APIs or any third-party integration; for example, do not use our integration to violate another platform’s rules or scrape data. Do not introduce any automated systems (bots, scripts) that send requests or perform activities on the Service in a manner not authorized (e.g., a bot that auto-starts streams or a scraper that collects personal info).
  • 5.6 Unauthorized Commercial Use: Do not use the free Service for commercial broadcasting or advertising placement that isn’t allowed. For instance, you cannot broadcast someone else’s content and charge for it using our app. You also cannot insert third-party ads or sponsorships into your stream in a way that violates Section 6 (Free Service and Advertising) or the policies of platforms (e.g., showing YouTube content with your own ads overlay violates YouTube’s policies). It’s fine to display a local sponsor’s logo using our provided features, but you cannot turn our Service into an ad network or resell streaming slots.
  • 5.7 Spam and Unwanted Content: Do not use the Service to transmit any unauthorized advertising or promotional materials (spam). For example, do not use the chat (if any) or stream descriptions to post repetitive promotions, referral codes, or irrelevant links. You also must not harass other users with unwanted contact or solicitations.
  • 5.8 Impersonation and Unauthorized Access: Do not impersonate StreamMySport, our staff, or any other person or entity. You should not falsely imply any affiliation or endorsement by us. Additionally, you must not use another user’s account without permission, or attempt to circumvent any account suspension or ban (e.g., by creating a new account if your account was terminated, without our permission).
  • 5.9 Third-Party Platform Rules: When using our app to stream to third-party services (YouTube, Facebook, Twitch, etc.), you must adhere to all rules of those platforms. This includes content guidelines, music policies, and any restrictions on multi-streaming. (For example, if you are a Twitch Affiliate or Partner, be aware Twitch may restrict simultaneous streaming to other platforms. It’s your responsibility to follow such rules. Breaking a platform’s rules can lead to action by that platform and is also a violation of our Terms.)

If you engage in any of the above prohibited conduct or otherwise breach these Terms, we may take action including suspending or terminating your account without notice, as detailed in Section 12. Serious violations may also be reported to law enforcement authorities where appropriate.

Free Service and Advertising


Free Version: StreamMySport offers a free, ad-supported version of the Service. If you use StreamMySport for free, you acknowledge and agree that we may display advertisements within the app or during your use of the Service. For example, you might see banner ads on the interface or short video ads at certain intervals or when initiating a stream. The exact nature and extent of advertising may change over time, and we may not always notify you of every change. We will strive to ensure ads do not overly disrupt your usage, but by using the free Service, you agree to the presence of such advertising. We may also occasionally show promotions for our own services (such as an in-app message about our Premium plan) which you similarly consent to receive.

Ad Content: We do not endorse or guarantee any third-party products or services advertised through our Service. We are not responsible for the content of ads or any third-party websites or resources that ads may link to. Any dealings you have with advertisers found on StreamMySport (for instance, clicking an ad and purchasing something) are solely between you and that advertiser. To the fullest extent permitted by law, we disclaim liability for any harm or losses arising from advertisements or subsequent dealings with advertisers. Please use your best judgment when interacting with any advertising or promotional material on the Service.

Personalized Ads: The free Service may deliver personalized or targeted ads based on information collected by us or ad partners (such as Google AdMob). Please review our Privacy Policy to understand how we handle ad-related data. By using the free Service, you agree that advertising content may not always be identified as “advertisements” in every instance (for example, content labeled “Sponsored” or promotions might appear in the interface), and that we may place such ads in or around your content (including possibly before/during a stream’s loading screen or in a scoreboard overlay as an ad space). We reserve the right to change the manner, mode, and extent of advertising without specific notice, but it will remain within reasonable bounds consistent with a free-to-use service.

Third-Party Ads and Tracking: Ads in the Service may be served by third-party ad networks which may use cookies or similar technologies to tailor ads to you. We do not control the ads’ content or the cookies they set. Our Privacy Policy details how you can opt-out of certain personalized ads if you wish.

No Ads in Premium: If you upgrade to our Premium subscription (see Section 7 below), we will not serve third-party advertisements in the Premium tier. Premium users can enjoy an ad-free experience within the app (though note, if you stream to a platform like YouTube or Facebook, those platforms might still serve ads to viewers according to their own policies; that is outside our app’s control).

Premium Subscriptions, Payments & Renewal


Premium Features: StreamMySport offers a paid Premium subscription (“Premium”) that provides access to enhanced app functionality and an ad-free experience. The scope and description of Premium features are presented within the app interface or on our website and may be updated from time to time as the Service evolves.

Platform Billing: Premium is sold as an auto-renewing subscription through the Apple App Store and/or Google Play Store (each a “Platform”). This means billing and payment processing are handled by the respective Platform under your Platform account, subject to that Platform’s payment terms. When you subscribe, you will be shown the applicable fee and billing period (e.g., monthly or annual) and you’ll be asked to authorize payment via your App Store or Google Play account. By confirming the purchase, you agree that the Platform may immediately charge you the listed subscription price, and will continue to charge you on a recurring basis (e.g., each month or year) until you cancel.

Your subscription will automatically renew at the end of each billing cycle (and your payment method will be charged each time) unless you cancel the subscription renewal before the next cycle begins. The renewal will be at the then-current subscription price, unless we have informed you of a price change (see “Price Changes” below).

Free Trials: We may offer new users a free trial of Premium for a certain period. If you start a free trial, you will not be billed until the trial period ends. On the day after the trial ends, the subscription will convert to a paid auto-renewing subscription and the first billing will occur, unless you canceled before the trial end. Each user is generally limited to one free trial (additional restrictions may apply).

Managing & Canceling Subscription: You can manage or cancel your StreamMySport Premium subscription at any time via the Platform’s account settings (for example, through the App Store or Google Play subscription management on your device). To avoid being charged for the next period, you must cancel the subscription at least 24 hours before the current billing period ends (the exact cutoff might vary by Platform). If you cancel in the middle of a billing period, you will retain access to Premium features until the end of that period already paid for, then the subscription will not renew. After cancellation, your app may revert to the free version with ads and standard features.

Alternatively, some Platforms allow a grace period after renewal for cancellation; but we strongly recommend cancelling ahead of time if you do not wish to renew. If you have any issue canceling, you may contact our support for guidance, but note that we cannot cancel on your behalf due to Platform restrictions – it must be done by you through the Platform.

Payment and Authorization: The subscription fee is charged immediately upon confirmation of purchase (after any free trial) and then on a recurring basis. All fees are stated and charged in [USD or local currency] and include any applicable taxes unless otherwise noted. By subscribing, you authorize the Platform (and its payment processor) to charge your designated payment method (such as the credit card or account you have on file with them) for the recurring subscription payments. If any subscription charge is refused or fails, we (via the Platform) may attempt to charge again or may terminate your Premium access at our discretion.

Price Changes: We reserve the right to adjust the pricing for our subscription at any time. If the price of your subscription changes, we will notify you in advance (generally via the Platform or in-app notification) and provide you the opportunity to cancel before the new price takes effect. If you do not cancel, the next renewal payment will be at the new rate. If you do cancel due to a price increase, you will continue to have access to Premium for the remainder of the period you already paid for, and will not be charged the new price.

No Refunds (Subscription): All subscription purchases are final and non-refundable. This means that if you cancel in the middle of a paid period, we do not issue a prorated refund for the remaining time in that period – you will retain Premium access until the period ends, but no partial refunds. Also, if your account is terminated for violating these Terms, you will not be entitled to any refund for the remaining subscription period (see Section 12). We rely on the Platforms’ standard refund policies for any exceptions: for instance, Apple may allow a refund for accidental purchases or under local consumer laws in some regions (e.g., EU 14-day withdrawal right for digital services, unless you waived it by using the service). Any refund requests must be directed to the Platform’s support. While we do not generally provide refunds directly, in certain cases of billing errors or other extraordinary circumstances, you can contact us and we may, at our sole discretion, arrange a refund or credit. Granting a refund or credit in one case does not entitle you to future concessions for similar cases.

Duplicate Subscriptions: You should subscribe to Premium on only one account. If for some reason you end up with multiple overlapping subscriptions (e.g., using two different Apple IDs), please contact us. We cannot guarantee refunds for duplicate subscriptions especially if they were purchased through the Platform due to user action. We advise you to double-check your active subscriptions in your device settings to avoid being charged more than once. In the event of a clear technical error on our side causing duplicate charges, we will work with you and the Platform to correct it.

Billing Issues: If you have any issue with billing (for example, you believe you were charged incorrectly), please contact us at info@streammysport.com within 30 days of the charge. We will review in good faith. If a charge was made in error, we’ll instruct the Platform to credit or refund as appropriate. Note that if you dispute a payment directly with your bank or card (a chargeback) without contacting us or the Platform first, it may result in automatic termination of your account by the Platform for security. It’s usually faster and easier to go through us or the official app store channels for resolution.

Taxes: Subscription fees are generally inclusive of taxes, but we follow Platform policies. The Platform may collect and remit taxes (like VAT, GST) as required by local laws. If any taxes or duties (other than income tax of our company) are due on your purchase and the Platform does not handle them, you are responsible for their payment.

Promotions: We may occasionally offer special promotions or discounts for Premium. Such promotions may be subject to additional terms and might be limited to new users or specific regions. We reserve the right to modify or withdraw promotional offers at any time.

Intellectual Property Rights & DMCA Policy

 

Our Intellectual Property: All content and materials provided by StreamMySport are the intellectual property of Tutun Solutions LLC or its licensors, except User Content as defined above. This includes the software code, design, graphics, the compilation of content, our trademarks (such as the “StreamMySport” name and logo), and any content created by us (text, images, tutorials, etc.). These are protected by copyright, trademark, patent (if applicable), and trade secret laws. You may not use, copy, or display our logos or branding without our express written permission, except as allowed by law (such as fair use). Nothing in these Terms shall be construed as granting you any right or license to our trademarks or other intellectual property, except for the limited right to use the Service in accordance with these Terms.

Feedback: If you provide us with any suggestions, ideas, or feedback about the Service (“Feedback”), you agree that we can use and implement that Feedback without any restriction or compensation to you. You hereby assign to us all right, title, and interest in any Feedback you provide (or, if an assignment is ineffective, you grant us a perpetual, sublicensable license to use the Feedback for any purpose).

Third-Party Content: Our Service may incorporate certain third-party software or content under license (including open source components). Use of such material is subject to the specific licenses and terms of those third parties, which may override portions of these Terms where applicable. We also might provide links to third-party websites or content as a convenience (see Section 9); that content is owned by the respective third parties, not us.

Copyright Infringement Policy (DMCA): StreamMySport respects the intellectual property rights of others and expects users to do the same. If you believe that any content accessible on or through our Service (for instance, a user’s stream or an image) infringes your copyright, you may send a compliant notice to our designated Copyright Agent under the U.S. Digital Millennium Copyright Act (DMCA) or equivalent laws:

Your DMCA Notice must: (i) identify the copyrighted work you believe is infringed (or a representative list if multiple works), (ii) identify the material that you claim is infringing, with enough detail for us to locate it (such as a broadcast ID, username, date/time, or a URL to a recorded segment if applicable), (iii) include your contact information (name, mailing address, telephone, email), (iv) include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law, (v) include a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf, and (vi) include your physical or electronic signature.

Upon receipt of a proper DMCA notice, we will review and, if appropriate, remove or disable access to the allegedly infringing content. We may notify the user who posted the content and, if it’s a misunderstanding or misidentification, they can file a counter-notification as permitted by DMCA. We have a policy to terminate accounts of repeat infringers in appropriate circumstances.

Counter-Notification: If you believe your content was removed or disabled by mistake or misidentification, you may send us a counter-notice. It should contain: (i) identification of what was removed and where it appeared, (ii) a statement under penalty of perjury that you believe the removal was a mistake or misidentification, (iii) your consent to the jurisdiction of the Federal Court in your district (or Delaware if outside the US) and agreement to accept service of process, and (iv) your signature. If we receive a valid counter-notice, we may restore the content after 10 business days unless the original complainant informs us they have filed a court action.

Note: Misrepresentations in DMCA notices or counter-notices can result in liability for damages (under DMCA Section 512(f)). If you’re unsure, consult an attorney.

Third-Party Services & Links


The Service interoperates with or links to third-party platforms and services, including but not limited to YouTube, Facebook, and Twitch. These integrations are provided for your convenience (for example, to stream your video feed to those platforms or to log in using those accounts).

Third-Party Terms: When using StreamMySport to access or interact with third-party services, you agree to abide by the terms and conditions of those third parties. This means, for example:

  • If you stream to YouTube via our app, you must comply with YouTube’s Terms of Service and Community Guidelines. YouTube’s Terms are available at https://www.youtube.com/t/terms and by using that feature you agree to be bound by them. We are using YouTube API Services, and Google’s Privacy Policy (http://www.google.com/policies/privacy) applies to data processed with that integration. You can revoke StreamMySport’s access to your Google/YouTube account at any time via the Google security settings page (https://security.google.com/settings/security/permissions).
  • If you stream to Facebook Live, you must adhere to Facebook’s Terms of Service (https://www.facebook.com/terms.php) and Community Standards.
  • If you stream to Twitch, you must comply with Twitch’s Terms of Service (https://www.twitch.tv/p/legal/terms-of-service) and Twitch’s Community Guidelines and policies. For instance, Twitch may prohibit certain content or simultaneous streams; you are solely responsible for following such rules.

We do not guarantee that any third-party service will permit your use via our app, or that they won’t change their APIs or rules in ways that affect your use. Your use of third-party platforms is at your own risk, and those platforms are not under our control.

No Responsibility for Third-Party Services: We do not endorse or assume any responsibility for any third-party sites, information, materials, products, or services. If our app provides a link or integration to a third-party resource, it’s for convenience and reference. We make no guarantees about the availability or functionality of any third-party integration. For example, if YouTube’s API is down or Facebook changes their live stream API, our feature might cease to function, and that’s outside our control. We will try to adapt to changes, but you agree that we are not liable for any interruptions or issues caused by third-party services.

When you access third-party content or services (including when you leave our app to view an external webpage via an ad link or otherwise), you do so under that third party’s terms and privacy policies. Any charge or obligation you incur in your dealings with those third parties is your responsibility, not ours.

Third-Party Login Data: If you use a third-party login (Google/Facebook/Apple), we may receive data from them as mentioned in Section 2. We handle that data per our Privacy Policy. We are not responsible for any breach or security issue originating from those services. If, for instance, your Google account is hacked and someone misuses our app through it, that’s governed by Google’s terms and you should address it with Google (though let us know as well).

Third-Party Open Source: (If applicable) The app may contain open-source software components. Those components are licensed under their own licenses, which are available in the app or documentation. To the extent required by those licenses, the terms of those licenses will apply to the respective components in lieu of these Terms.

Disclaimer of Warranties


Use At Your Own Risk: StreamMySport is provided to you on an “AS IS” and “AS AVAILABLE” basis. Your use of the Service is at your sole risk. To the maximum extent permitted by law, we (and our affiliates, partners, and suppliers) expressly disclaim all warranties and conditions of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will meet your requirements or expectations, or that it will achieve any particular result.

In particular, we do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free. We do not promise that you will be able to stream without any disruptions or that our servers will always be available. There may be occasional downtime for maintenance or factors outside our control (such as internet outages, network issues, etc.).
  • Any information or results obtained through the Service will be accurate or reliable. For example, we don’t warrant that the scorekeeping feature will be error-proof or that viewers will receive notifications promptly.
  • Any defects or bugs will be corrected. We aim to fix issues, but the Service is complex and provided “as is.”
  • The Service is free of viruses or other harmful code. We take security seriously and use measures to protect our software, but we cannot guarantee there won’t be any security vulnerabilities or malicious attacks.

Any content you stream or download through the use of our Service is done at your own discretion and risk. You will be solely responsible for any damage to your device or loss of data that results from using the Service or viewing any content through the Service.

No Responsibility for Content: We do not endorse any User Content or any content streamed through our Service. We make no representations or warranties regarding any content distributed via StreamMySport, and we expressly disclaim any liability for user conduct or user content. For example, we aren’t liable if you find a user’s commentary offensive or if someone streams something illegal – though we ask users not to do that and will take action when we become aware, as described. You acknowledge that live streams are not reviewed by us before being broadcast, and viewers may be exposed to content that is inaccurate, inappropriate, offensive, or even unlawful. To the furthest extent allowed, we will not be liable for any such exposure.

Third-Party Services: We also disclaim any warranties regarding third-party services or integrations. We do not guarantee that streaming to YouTube, Facebook, Twitch, or any other third-party will work perfectly or continuously. Any issues arising from those services are solely between you and the respective third party. We provide the integration “as is,” and if those third parties change or terminate their services, we are not responsible for any resulting lack of functionality.

Beta Features: If we release Beta features (experimental features) to you, those are provided without any warranties whatsoever – they might be even more likely to have issues. Use them voluntarily and understand they could be changed or discontinued at any time.

Consumer Rights: Some jurisdictions do not allow the exclusion of certain warranties. If you are entitled by law to any guarantees (for example, certain statutory warranties under EU consumer law), then nothing in these Terms will affect those statutory rights. In such cases, our warranty obligations will be limited to the minimum extent required by the applicable law.

Limitation of Liability


To the maximum extent permitted by applicable law, in no event shall Tutun Solutions LLC (StreamMySport) or its affiliates, officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential or punitive damages whatsoever. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, device damage, or other intangible losses arising out of or related to your use of or inability to use the Service (or the cost of procuring substitute services), even if we have been advised of the possibility of such damages.

Without limiting the foregoing, we will not be liable for:

  • any damage resulting from any User Content or conduct of any user of the Service (e.g., something another user streams or does),
  • any damage caused by mistakes, omissions, or inaccuracies in any content (such as an incorrect score or commentary),
  • any unauthorized access to or use of our servers and/or any personal information stored therein,
  • any interruption or cessation of transmission to or from the Service,
  • any bugs, viruses, Trojan horses, or similar, which may be transmitted to or through our Service by any third party,
  • any issues with third-party platforms (like if a stream fails on YouTube’s side or your content is removed by Twitch, or their service causes you harm),
  • or loss of your content (as we’ve noted we don’t permanently store streams; ensure you have backups if needed).

In no event will our total cumulative liability to you for any claims arising out of or relating to these Terms or the Service exceed the total amount that you have paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to such liability.

Indemnification


You agree to indemnify, defend, and hold harmless Tutun Solutions LLC, its parents, affiliates, officers, agents, employees, partners, and licensors (collectively, the “Indemnified Parties”) from and against any and all third-party claims, liabilities, losses, damages, expenses, and costs (including reasonable attorneys’ fees) that arise out of or are related to: (a) your use or misuse of the Service, (b) your User Content (including any actual or alleged infringement by your content of a third party’s rights), (c) your violation of these Terms, or (d) your violation of any law or regulation or of any rights of another.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with us in asserting any available defenses). You agree not to settle any such matter without our prior written consent. This indemnification obligation will survive any termination of your account or of the Service.

  1. Suspension and Termination of Service
    Termination by You: You may stop using the Service at any time. If you wish to delete your account, you may do so through the account settings (if available) or by contacting us at info@streammysport.com. Deleting the app from your device will not automatically cancel any ongoing subscription; you must cancel subscriptions via the app store as described in Section 7 to stop recurring charges.

Termination or Suspension by Us: We reserve the right to suspend or terminate your access to the Service (or any portion thereof) at any time, for any reason, at our sole discretion. We may do so with or without prior notice. Cause for suspension/termination may include (but is not limited to):

  • breach or violation of these Terms or any other incorporated agreements or guidelines,
  • requests by law enforcement or other government agencies,
  • unexpected technical or security issues or problems,
  • if we determine your use creates risk of legal liabilities or is fraudulent, illegal, or offensive,
  • extended periods of inactivity of a free account,
  • or if we discontinue the Service (in whole or in part).

In particular, if you engage in Prohibited Conduct (Section 5) or seriously violate intellectual property rights or other users’ rights, we may immediately terminate or ban your account. For less serious issues, we may choose to give a warning or suspend access (e.g., temporary ban) before termination, but we are not obligated to do so.

Effect of Termination: Upon termination of your access or account for any reason, your right to use the Service will immediately cease. You must stop all use of the Service and uninstall the app. We may, without liability to you or any third party, remove or discard any content or data associated with your account (subject to our data retention policies and Privacy Policy). However, certain sections of these Terms will survive termination, including those relating to intellectual property, disclaimers, limitations of liability, dispute resolution, and other provisions which by their nature should survive. Termination of your account does not relieve you of any obligation to pay any accrued fees or charges (e.g., any outstanding subscription balances).

If we terminate your account due to violation of these Terms or legal requirements, you are not entitled to any compensation or remedy (such as any refund for subscription days lost) except where required by law. If we discontinue the Service entirely (shut down), we will make reasonable efforts to notify active subscribers and may provide a prorated refund for the remaining subscription term, if required or at our discretion.

We also reserve the right to terminate or suspend any stream or broadcast that is in progress, if we have reason to believe it violates these Terms or law, without prior notice to you.

Account Reactivation: If appropriate and at our sole discretion, we may reactivate a suspended account once the issue is resolved (for example, if you were suspended for a suspected copyright issue that was later cleared up). However, we are under no obligation to reinstate accounts.

Governing Law & Dispute Resolution

 

Governing Law: These Terms and any dispute arising out of or related to them or the Service will be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. However, if you are a consumer in a jurisdiction where the local law mandates that another law (such as the law of your country of residence) applies to certain issues, then that local law may govern those specific issues. The U.N. Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.

Arbitration Agreement: Please read the following paragraphs carefully, as they require you to arbitrate disputes with us and limit the manner in which you can seek relief. This arbitration provision shall survive termination of the Terms.

  • Initial Dispute Resolution: Most concerns can be resolved quickly by contacting our support at info@streammysport.com. You agree to try in good faith to resolve any dispute, claim, or controversy informally by contacting us and providing a brief written description of the issue and your contact information, before taking any formal legal action.
  • Binding Arbitration: If we are unable to reach an informal resolution within 30 days of the issue being raised (or another timeframe we mutually agree on), you and Tutun Solutions LLC agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (including the breach, termination, enforcement, interpretation, or validity thereof), shall be solely and finally resolved by binding arbitration. You are thus waiving your right to litigate in court (except for matters that may be taken to small claims court). The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules, as appropriate) in effect at the time the arbitration is initiated, except as modified by these Terms. You can find AAA’s rules at www.adr.org.
    • The arbitration will be conducted by a single, neutral arbitrator. If the parties cannot agree on an arbitrator, the AAA will appoint one.
    • Arbitration Location: If you are a consumer, the arbitration may be conducted in the U.S. county where you reside (or city/province if outside the U.S.), or another location mutually agreed upon, or via video/telephonic means if in-person is not reasonably feasible. If you are not a consumer or if no specific law requires otherwise, the default location shall be in the State of Delaware, USA.
    • Arbitration Language: The arbitration shall be conducted in English, unless otherwise required by law or agreed.
    • Arbitration Fees: Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules. We will reimburse your portion of the arbitration fees (excluding your attorneys’ fees) for claims totaling less than $10,000 unless the arbitrator determines your claims are frivolous. Each side bears its own attorneys’ fees and costs unless the arbitrator rules otherwise or an applicable law requires awarding fees to the prevailing party.
    • Authority of Arbitrator: The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this arbitration agreement is void or voidable. The arbitrator can grant any relief that a court could, but only on an individual basis (see below re: class waivers).
  • Class Action Waiver: You and we agree that any claims must be brought on an individual basis only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate or join the claims of more than one person or party, and may not otherwise preside over any form of a representative or class proceeding.The arbitrator cannot award class-wide relief. If this specific “Class Action Waiver” provision is found to be unenforceable, then the entirety of this Arbitration Agreement section shall be null and void, but the rest of the Terms shall continue to apply.
  • Exceptions: Notwithstanding the foregoing, either party may seek relief in a small claims court for disputes or claims within the scope of that court’s jurisdiction (e.g., if your claim qualifies for small claims, you can choose to pursue it there instead of arbitration). Also, either party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights (this does not require arbitration – e.g., we could directly go to court to stop someone from illegally distributing our app, and you could go to court to stop someone from using your copyrighted content unlawfully).
  • Opt-Out: You have the right to opt out of the arbitration agreement in this Section by sending us a written notice of your decision to opt out at info@streammysport.com or to our mailing address: Tutun Solutions LLC, Attn: Legal/Arbitration Opt-Out, 8 The Green, Suite A, Dover, DE 19901, USA. This notice must be sent within 30 days of first accepting these Terms (if you already agreed and this is your first chance to opt out, you must opt out within 30 days of this Terms update). The notice must clearly state your name (or user name), your mailing address, the email associated with your account, and that you wish to opt out of the arbitration agreement. If you opt out, then Section 14’s arbitration provisions do not apply to you. Opting out will not affect any other parts of these Terms, including e.g. the class action waiver in litigation. If you don’t opt out by the deadline, you and we shall be bound by the arbitration agreement terms.
  • Future Changes to Arbitration Clause: If we make any future change to this arbitration agreement (other than a change to our contact address), you can reject that change by sending us written notice within 30 days of the change to our contact email (or physical address). By rejecting a new change, you are agreeing that you will arbitrate any dispute in accordance with the language of this provision as of the date you first accepted these Terms (or accepted any subsequent changes to these Terms).

Jurisdiction for Litigation: In the event the arbitration provision is found not to apply to you or your claim (for example, if you opt out, or if it’s deemed unenforceable), or in the event a claim proceeds in court for any reason, you agree that any judicial proceedings (other than small claims) will be brought in the state or federal courts of Delaware, USA. Both you and we consent to venue and personal jurisdiction in such courts, and waive any objections on grounds of inconvenient forum. You also agree to waive any right to a jury trial in such cases, to the extent permitted by law.

One Year Limitation: To the extent permitted by law, any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim arose; otherwise, it is permanently barred (This does not apply to users in jurisdictions where such time limit is prohibited by law.)

Consumer Rights Notice (California): Under California Civil Code Section 1789.3, users of the Service from California are entitled to receive specific consumer rights information. If you have a question or complaint, please send a letter to the address listed in Section 15 and California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834 or by telephone at (916) 445‑1254 or (800) 952‑5210.

Miscellaneous

 

  • Entire Agreement: These Terms (along with our Privacy Policy and any other guidelines or additional terms provided within the Service for particular features) constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements, understandings, or communications (whether oral or written) relating to the subject matter hereof.
  • No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver must be explicit and in writing to be effective.
  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
  • Assignment: You may not assign or transfer these Terms or any of your rights or obligations hereunder, in whole or in part, without our prior written consent. Any attempted assignment in violation of this provision is void. We may freely assign these Terms or delegate any obligations hereunder, in whole or part, to any third party, in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise.
  • Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargoes, fire, pandemics, natural disasters, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials, or the failure of any third-party platform, network, or technology.
  • Relationship: These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and us.
  • Headings & Language: Section headings in these Terms are for convenience only and have no legal effect. The language of these Terms shall be interpreted according to its fair meaning and not strictly for or against either party. The original language of these Terms is English. If these Terms are translated into another language, the English version will prevail to the extent of any conflict or ambiguity in interpretation.

User Generated Content & Community Guidelines

StreamMySport allows users to create and upload certain user-generated content, including stream titles, descriptions, logos, GIFs, videos, replay clips, profile information, and other media related to sports broadcasts.

By using the Service, you agree that you will NOT upload, publish, stream, share, or distribute any content that:

  • Contains nudity, pornography, or sexually explicit material
  • Promotes violence, hate speech, harassment, or abuse
  • Contains illegal, harmful, or defamatory content
  • Infringes copyrights, trademarks, or other intellectual property rights
  • Contains spam, misleading information, or malicious content
  • Violates any applicable laws or regulations

StreamMySport maintains a zero-tolerance policy for objectionable content and abusive users.

We reserve the right to:

  • Remove any content at our sole discretion
  • Suspend or permanently terminate accounts violating these rules
  • Restrict access to certain features or services
  • Cooperate with law enforcement authorities where required

Users may report objectionable content or abusive behavior directly through the application.

Reported content is reviewed by our moderation team and may be removed within 24 hours if found to violate these Terms.

Users may also block other users inside the application to prevent unwanted interactions.

We may use automated filtering mechanisms and moderation tools to detect and prevent prohibited content.

By uploading content to StreamMySport, you confirm that you own the rights to such content or have the necessary permissions to use and distribute it.
